About Deslinde

A delinde, or demarcation, is where a newly sold piece of property is separated from a larger piece of property. A few years ago, as an example, Jose owned a big piece of land. One day he sold a small piece of it to Carlos. Carlos received a legal Bill of Sale, took it to the Land Tribunal, registered his ownership of the smaller piece, and was issued a legal registered title. The problem with this is that Jose’s registered title still said he owned the smaller piece. When there was a direct chain of ownership this was not really a problem. But if Carlos sold his piece to Miguel, who sold to Pedro, and Carlos died, or got lost, there was no longer a provable ownership chain back to the original piece of land. And there would be occasional disagreements about who owned what. When the Deslinde law came into effect, any new registered title issued had to be subtracted/demarked from the original piece of land.

In the Dominican Republic, especially in the countryside, the vast majority of land sales have been done without a deslinde for decades. Any property purchased before the Deslinde law, is ‘grandfathered-in’ meaning it can be sold legally without a deslinde. The new buyer, however, would have to get a deslinde before he could sell the property again. There is some time and expense in obtaining deslindes. For this reason there is an informal two-level valuation system. Non-deslinded properties are often sold at a discount to deslinded properties to reflect the time and cost of needing to get one if you want to sell at some point in the future.

The properties listed on Luperonforsale.com are a mix. Some have deslinde, some not (grandfathered-in) , and some do not require one.
